SAN FRANCISCO (KRON) — California’s “locked door loophole” invoice is about to enter impact Wednesday as considered one of a number of new 2025 legal guidelines statewide and nationwide. Authored by California State Sen. Scott Wiener (D-San Francisco), Senate Invoice 905 was signed into legislation by Gov. Gavin Newsom final summer season.

SB 905 will not require California automotive house owners to show their automotive was locked when it was damaged into. As an alternative, indicators of forcible entry — a damaged window for instance — will suffice to show that the crime of auto housebreaking was dedicated.

“On Wednesday, a car break-in law I wrote goes into effect,” wrote Sen. Wiener on Reddit Monday. “It’ll make it easier to hold people accountable for breaking into cars.”

Wiener has been a long-time proponent of a invoice to finish the locked door loophole, which, beneath present legislation, requires automotive house owners to be keen to testify beneath penalty of perjury that their automotive was locked when damaged into. He first sponsored a invoice to shut the loophole again in 2018.

SB 905 represents the third time the San Francisco state senator has authored a invoice to shut the loophole. Beforehand, Wiener described the prevailing legislation as “a senseless barrier to holding auto burglars accountable.”

“Senate Bill 905 ends the absurd loophole requiring proof not just of a break-in but also that all doors to the car were locked,” Wiener mentioned. “Under long standing law in California, if you own a car but don’t recall (i.e. can’t testify under penalty of perjury) whether you locked all of the doors — or if you’re a visitor who rented a car here and you’re now far away and no longer here to testify you locked the doors — the case can be lost even with proof that the person broke into the car.”

“With SB 905’s passage, this dumb ‘locked door loophole’ will finally end,” Wiener mentioned.

The invoice was backed by the workplace of outgoing San Francisco Mayor London Breed.
